TERMS AND CONDITIONS
1. DEFINITIONS AND TERMS
Wolep.com - is the trade name of SC Avocatura Com SRL, a legal entity of Romanian nationality, having its registered seat in Galați, str. N. Bălcescu nr. 56, registered with the Trade Register under number J17/380/2004, tax identification code 16234725.
Seller – Avocatura Com SRL for the services sold by it to sole traders who cumulatively meet the following conditions:
- Are in the capacity of a Lawyer and have the right to practice the legal profession according to the specific legislation of the country in which they practice the legal profession, as well as the forms of exercising the profession;
- Have joined the WOLEP International Network of Lawyers - "World Online Lawyers with Excellent Practice".
Lawyer – Is a sole trader who cumulatively meets the following conditions:
– Is in the capacity of a Lawyer and has the right to practice the legal profession according to the specific legislation of the country in which they practice the legal profession, as well as the forms of exercising the legal profession (Law Firms, etc.);
– Has joined the WOLEP - "World Online Lawyer with Excellent Practice" International Network of Lawyers.
WOLEP International Network of Lawyers – "World Online Lawyer with Excellent Practice" – Is an associative entity formed solely by Lawyers, to which Lawyers who enjoy professional appreciation from other fellow Lawyers and who undertake to practice the legal profession in compliance with the following principles are invited to join:
Membership of Lawyers in the WOLEP International Network of Lawyers does not give rise to situations of professional incompatibility or conflict of interest for Lawyers who have joined the WOLEP Network because Lawyers undertake to observe the professional secrecy and confidentiality of the Client - Lawyer relationship. The information held by WOLEP Lawyers is not shared with other WOLEP Lawyers.
Fee - represents the amount of money, for a time interval of 30, 60 or 90 minutes, which represents the price charged by the Lawyer for providing the Online Legal Consultancy service, the Drafting of a Legal Document.
Returned Fee - represents the amount of money, due by a Lawyer to another Lawyer (or forms of exercising the profession) if they have agreed on a Professional Cooperation in the form of performing legal activities or in the form of Client sharing.
Purchaser - can be any natural person over the age of 16 or a legal entity or any legal entity that creates an Account on the Wolep.com Website and makes an Order to purchase Online Legal Consultancy Services.
Purchaser Lawyer - is any sole trader in the capacity of a Lawyer, meets the conditions from the definition of Lawyer specified above, who makes an Account on the Wolep.com website and makes an Order for purchasing services provided by Avocatura Com SRL to the Lawyers.
Client - can be any natural person over the age of 16 or a legal entity that has or obtains access to the Online Legal Consultancy platform provided by Wolep.com, through any means of communication provided by Wolep.com (electronic, telephone, etc.), chosen in agreement with a Lawyer from the WOLEP International Network of Lawyers or on the basis of a user agreement existing between Wolep.com and them and which requires the creation and use of an Account.
User - any natural person over the age of 16 or legal entity registered on the Website, that, by completing the process of creating the Account, has agreed to the website-specific clauses in the General Terms and Conditions section.
Nickname - a pseudonym by which a certain User/Client/Purchaser can add Content to the Website. The nickname is associated with the information on the Website of the User/Client/Purchaser under the name of "Username".
Account - the section of the Website that can be accessed after entering an e-mail address and a password and that enables Seller Lawyer, Purchaser, Purchaser Lawyer or Client to send the Order or provide Online Legal Consultations, as well as Professional Collaborations between Lawyers. The user shall be responsible and shall ensure that all information entered when creating the Account is true, correct, complete and up to date.
Accounts can be:
Website - publication and online store hosted at Wolep.com and its subdomains.
Order - an electronic document that intervenes as a form of communication between the Seller and the Purchaser by which the Purchaser conveys to the Seller, through the Website, their intention to purchase Services from the Website. This definition is also valid for the Seller Lawyer or Purchaser Lawyer and shall be understood according to the context of the legal relationship in which they are found.
Services - any service listed on the Website, including the services mentioned in the Order, to be provided by the Seller (Seller Lawyer), to the Purchaser (Purchaser Lawyer) as a result of the order placed and its acceptance.
Online Legal Consultancy - Online Legal Consultancy services provided exclusively by sole traders who are in the capacity of a Lawyer, services that are available to the general public through the Wolep.com website.
Drafting of Legal Documents - are legal services that consist in the drafting by a Lawyer of one or more legal documents, upon request of a Client, through the Wolep.com website and for which the Client pays a Fee in the amount agreed with the Lawyer.
Services provided by Wolep.com - those services provided by Avocatura Com SRL through the Wolep.com website, exclusively to Lawyers, and which are intended to: promote a public image of their professionalism, increase professional notoriety, implement a branding process, provide paid Online Legal Consultations (through the platform owned by the website), the Professional Cooperation of Lawyers who have joined the WOLEP International Network of Lawyers.
Campaign - the action of exhibiting for commercial purposes a finite number of Services, for a limited period of time set by the Seller.
Contract – represents the remote contract concluded between the Seller and the Purchaser, without their simultaneous physical presence.
Legal Assistance Contract - The Contract regulated by the legislation specific to the Legal Profession under which Lawyers can provide Online Legal Consultancy services. For the Online Legal Consultations provided by Lawyers through the Wolep.com website, the Legal Assistance Contract shall be concluded remotely, the consent of the Parties involved being expressed through the technical means specific to the internet environment.
Content - represents:
Review – an assessment written by the beneficiary of a Service, based on their personal experience and ability to make qualitative comments and to state whether or not the Service complies with the expected standard of legal practice.
Rating - a way of expressing the degree of satisfaction of a User/Client/Purchaser towards an Online Legal Consultancy service. The rating is expressed in the form of stars, each Seller Lawyer being able to receive a score from one star to five stars. This degree of satisfaction could be associated with a Review written by the User/Client/Purchaser on the Online Legal Consultancy Service provided by a Seller Lawyer.
Document – these Terms and Conditions.
Commercial Communications - any type of message sent (such as: e-mail/SMS/telephone/mobile push/webpush/etc.) containing general and thematic information, information on services similar or complementary to those you have purchased, information regarding offers or promotions, information about the Services added in the “My Wolep” section, as well as other commercial communications, such as: market research and surveys.
Notifications - any type of message sent by e-mail or SMS, through which Wolep.com notifies Users about the status of an Order, the steps taken by an Order, starting with its initialization and ending with the invitation to add a Rating or Review.
The “Delivery of the order can begin” notification - that message sent by e-mail or SMS by which Wolep.com notifies the Seller Lawyer and the Purchaser Client that the Online Legal Consultancy Service can be delivered and is proof that the platform provided by Avocatura Com SRL is available and can be used by the Seller Lawyer and the Purchaser.
Transaction - the collection or reimbursement of an amount resulting from the sale of a Service by Wolep.com or by the Seller Lawyer to the Purchaser, Purchaser Lawyer or Seller Lawyer, by using the card processor services agreed by the Seller, regardless of the delivery method.
Standard of practice - that standard of legal practice that enables the Lawyer to provide Legal Consultations even Online so that the beneficiary of the legal consultation receives relevant and sufficient information in order to be able to discern on the legal issue presented to the lawyer honestly.
1-click payment - the payment service provided by the payment processor integrated in the Website, made available to Clients, Users and/or Purchasers through the Website in order to make an online card payment.
Token - a unique encrypted number associated with the Purchaser's payment card after making an online payment, after activating the PaybyClick service and which can be used by the purchaser to authorize Transactions through the PaybyClick service.
2. CONTRACTUAL DOCUMENTS
2.1. By registering an Order on the Website, the Purchaser, the Client or the Purchaser Lawyer agrees with the form of communication (telephone or e-mail), through which the Seller and the Lawyer carry out their commercial operations or legal services.
2.2. The notification received by the Purchaser, or the Client, after placing the Order, has informative role and does not represent the acceptance of the Order. This notification is made electronically (e-mail) or by telephone.
2.3. For justified reasons, the Seller reserves the right to cancel an Order and undertakes to refund the amount paid by the Purchaser, or by the Purchaser Lawyer without being obliged to pay any damages regardless of their justification.
2.4. The contract shall be deemed concluded between the Seller and the Purchaser or the Purchaser Lawyer upon receipt by the Purchaser (Purchaser Lawyer) of the "Delivery of the Order can begin" Notification sent from the Seller, by e-mail and/or SMS.
2.5. For the Orders launched by the Purchasers Lawyers to be delivered by Avocatura Com SRL through the Wolep.com website, the delivery time is the one presented in the description of the service or the one agreed through the e-mail correspondence carried.
2.6. The Document and the information provided by the Seller on the Website shall be the basis of the Contract.
3. ONLINE SALES POLICY
3.1. Access for the purpose of placing an Order is allowed to any User/Purchaser.
For justified reasons, Wolep.com reserves the right to restrict the access of the User/Purchaser to place an Order and/or to some of the accepted payment methods, if it considers that based on the conduct or activity of the User/Purchaser on the Website, their actions could harm Wolep.com in any way. In any of these cases, the User/Purchaser can contact the Client Relations Department of Wolep.com, to be informed of the reasons that led to the application of the above measures.
3.2. Communication with the Seller can be made through direct interaction with the Seller or at the addresses mentioned in the "Contact" section of the Website. The Seller is free to manage the information received without having to justify it.
3.3 In the event of an unusually high volume of traffic from an Internet network, Wolep.com reserves the right to require Users/Purchasers to manually enter captcha validation codes in order to protect the information on the Website.
3.4. Wolep.com may publish on the Website information about Services and/or promotions used by it or by any other third party with which Wolep.com has concluded partnership agreements, in a certain period of time.
3.5. All fees related to the Online Consultancy Services presented on the Website shall be expressed in the currency chosen by the Lawyer and include VAT, except for the Services intended exclusively for Lawyers, which shall be expressed in euros (EUR) and do not include VAT.
3.6. In the case of online payments, the Seller is not/cannot be held liable for any additional costs incurred by the purchaser, including but not limited to currency conversion commissions applied by the issuing bank of their card, if the currency of its issuance differs from the currency in which the Fee is established. The liability for this action lies solely with the Purchaser.
3.7. All the information used for the description of the Services available on the Website (static/dynamic images/multimedia presentations / etc.) does not represent a contractual obligation on the part of the Seller and is used exclusively as a presentation.
3.8. After a maximum of 1 hour (one hour) from the delivery of an Online Legal Consultancy Service, the Purchaser shall be required to register a Review related to the purchased Service. The request shall be sent to the email address entered by the purchaser in the Account. In this way, the Purchaser, contributes to informing other possible Users/Clients/Purchasers on the Website and is actively involved in the development of new Services and in the assessment of the professionalism of the Lawyer Seller.
4. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHT
4.1. The content, as defined in the preamble, including but not limited to logos, stylized representations, trade symbols, still images, dynamic images, text and/or multimedia content presented on the Website, are the exclusive property of Avocatura Com SRL, and all the rights obtained in this respect directly or indirectly (through licences to use and/or publication are reserved thereto. The images, logos, descriptions or presentations contained in the Profile Pages belonging to the Lawyers or the forms of exercising the profession, are not protected in favour of Avocatura Com SRL. They belong to the respective Lawyer or to the respective form of exercising the profession.
4.2. The Client/Purchaser/User is not allowed to copy, distribute, publish, transfer to third parties, modify and/or otherwise alter, use, link to, exhibit, include any Content in any context other than the original one intended by Wolep.com. The inclusion of any Content outside the Website, the removal of signs that signify the copyright of Wolep.com over the Content, as well as participation in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the Content is only permitted with the express written consent of Avocatura Com SRL.
4.3. Any Content to which the Client/Purchaser/User has and/or obtains access by any means is subject to the Document, if the Content is not accompanied by a specific and valid user agreement concluded between Wolep.com and them, and without any implied or express warranty made by Wolep.com with respect to that Content.
4.4. The Client/Purchaser/User may copy, transfer and/or use Content only for personal or non-commercial purposes, only if they do not conflict with the provisions of the Document.
4.5. If Wolep.com grants the Client/Purchaser/User the right to use, in the form described in a separate user agreement, a certain content, to which the Client/Purchaser/User has or obtains access as a result of this agreement, this right shall extend only to that or those contents defined in the agreement, only during the existence of this or these contents on the website or during the period defined in the agreement, according to the defined conditions, if they exist, and shall not represent a contractual commitment on the part of Wolep.com for that Client/Purchaser/User or any other third party who has/obtains access to this transferred content, by any means, and who might be or is harmed in any way as a result of this content, during or after the expiration of the user agreement.
4.6. No Content transmitted to the Client, User or Purchaser, by any means of communication (electronic, by telephone, etc.) or acquired by them by accessing, visiting and/or viewing does not constitute a contractual obligation on the part of Wolep.com and/or of the Wolep.com’s employee/agent who has intermediated the transfer of the Content, if any, to that content.
4.7. Any use of the Content for purposes other than those expressly permitted by this Document or by the accompanying the user agreement, if any, is prohibited.
5. ONLINE LEGAL CONSULTANCY SERVICES
The provisions of this section are applicable both for Online Video-Audio Legal Consultations and for Written Legal Consultations - Drafting of Legal Documents.
5.1. Online Legal Consultancy Services are provided exclusively by sole traders in the capacity of a Lawyer who have the right to practice the legal profession according to the specific legislation of the country in which they exercise the legal profession.
5.2. Avocatura Com SRL makes available exclusively to sole traders in the capacity of a Lawyer and who have joined the WOLEP International Network of Lawyers the Wolep.com platform and the IT infrastructure consisting of the application that technically enables the provision of Online Legal Consultations, video and/or audio, and the drafting of Legal Documents, by the Lawyers, the payment of this service by the Clients and the collection by the Lawyers of the equivalent value of the service provided, the Fee, from Avocatura Com SRL.
5.3. The legal relationship based on which the Online Legal Consultancy service is provided shall be concluded between the Lawyer and the Client, and the Legal Assistance Contract shall have the legal regime of Remote Contracts between absentees. Avocatura Com SRL through the Wolep.com website, with regard to the content of the Online Legal Consultancy service, only provides the IT infrastructure that enables the delivery of such a service between absentees and ensures the confidentiality of the conversation and communications.
5.4. All sole traders in the capacity of a Lawyer, as well as the forms of exercising the legal profession, have the right to use the Wolep.com platform and the IT infrastructure consisting in the application that enables from a technical point of view the provision of Online Legal Consultations by Lawyers, the payment for this service and the collection by Lawyers of the equivalent value of the service provided by Avocatura Com SRL, if they agree to conclude a Contract for Use with Avocatura Com SRL and to pay the equivalent of the annual User Fee to which is added a Usage Fee representing a percentage of the amount of the fee charged by the Lawyer for the Online Legal Consultancy service. The Usage Fee covers the costs that Avocatura Com SRL incurs with: the payment processor, the bank commissions and does not represent a payment for procurement of Clientele for Lawyers.
5.5. Purchasers Lawyers state and undertake to provide Online Video/Audio Legal Consultancy at a high standard of practice so that Clients find out the appropriate and sufficient legal information in order to be able to discern on the legal issue on which the Lawyer has provided consultancy through Wolep.com.
5.6. Avocatura Com SRL does not claim and does not wish to benefit from any remuneration from Lawyers if a Client who has interacted with a Lawyer through our website has decided that other legal services, except for Legal Consultancy Online, be provided to them as well by that Lawyer.
5.7. Lawyers can freely establish the amount of the fees for Online Legal Consultancy provided through Wolep.com, but not less than the minimum fee established by the Contract concluded between Avocatura Com SRL and Lawyer.
5.8. Lawyers undertake to provide Online Legal Consultancy at the date and time agreed with the client and for the entire ordered duration.
5.9. The Purchaser Client has the right to benefit from Online Legal Consultancy for the entire period of time for which they paid. In this regard, the Lawyer shall state to agree and undertakes that: if an ordered and paid Legal Consultancy has not been provided for the entire period of 30, 60 or 90 minutes, they agree to a new rescheduling of the Consultation, and undertakes to provide the client with the legal service paid by them for the remaining time. The Purchaser Client may request rescheduling within the next 30 days from the date of the first appointment.
5.10. The invoice related to the Online Legal Consultancy service shall be issued by the Lawyer, the provider of the Online Legal Consultancy service, through an automated system, made available by Wolep.com and shall sent by email to the Client after the service is provided.
5.11. Wolep.com collects from the Client, before the moment when the Online Legal Consultancy starts, through an online payment by credit card, the full amount of the fee established by the Lawyer and undertakes to transfer these amounts to the Lawyer's bank account.
For purchasers (clients)
5.12. Any natural person or representative of any legal entity has the right and can benefit from Online Video/Audio Legal Consultancy through the Wolep.com website.
5.13. The user can choose, freely and unrestrictedly, to schedule and obtain an Online Legal Consultancy from any Lawyer who has previously chosen to provide such legal services through Wolep.com, except for that lawyer(s) about whom the User knows or suspects that they are in a professional relationship with a person with whom the User has a legal dispute.
5.14. The User states and undertakes that, for whatever reasons they consider relevant, shall not request, order or pay for an Online Video/Audio Legal Consultancy through Wolep.com with a Lawyer they know or suspect to be or has been in a professional relationship with a person against whom the User would have contrary legal interests. For better clarity, we specify that: The User knows and states to have understood that any attempt to establish professional relations with a Lawyer that they know or suspect that would represent or could represent the judicial interests of another person with whom the User is or could be in a legal dispute, is a breach of the purpose for which the facility to benefit from Online Legal Consultancy was publicly offered through the Wolep.com website and undertakes to bear any damages claimed by anyone from Wolep.com and which are related to an incompatibility or conflict of interest of a Lawyer consulted by the User.
5.15. In order to avoid situations of professional incompatibility and conflict of interest, the User undertakes to inform the Lawyer, as soon as possible, what the legal issue is and with whom they might be in a judicial dispute related to that legal issue and to require the Lawyer to inform them if they are in a situation of incompatibility or conflict of interest.
5.16. In order to benefit from Online Legal Consultancy through Wolep.com, the User must complete the following steps:
- To open an Account on Wolep.com;
- To choose a Lawyer from those who have decided to provide Online Legal Consultancy through Wolep.com;
- To choose the duration of the ordered consultancy, agreeing with its displayed equivalent value;
- To establish with the Lawyer, through the application, the date and time at which the Consultation will take place;
- To pay in advance the amount of the service ordered by credit card payment;
- To call the Lawyer at the set time by pressing the “Start Conversation” button.
5.17. The Purchaser Client has the right to benefit from Online Legal Consultancy for the entire period of time for which they have paid. In this respect, if an Online Legal Consultancy has been interrupted, for any reason, the Purchaser Client has the right to obtain a new rescheduling with the same lawyer, in the next 30 days, when they will benefit from Online Legal Consultancy also for the remaining time from the paid order.
5.18. The legal relationship based on which the Online Legal Consultancy service is provided shall be concluded between the Lawyer and the Client, and the Legal Assistance Contract has the legal regime of Remote Contracts between absentees. Avocatura Com SRL through the Wolep.com website, with regard to the content of the Online Legal Consultancy service, only provides the IT infrastructure that enables the delivery of such a service between absentees and ensures the confidentiality of the conversation and communications carried out through the website. As the communication between the Lawyer and the Client is completely confidential, Wolep.com does not take any liability regarding the content of the Legal Consultancy provided by the Lawyer.
5.19. The invoice related to the Online Legal Consultancy service shall be issued by the Lawyer, the provider of the Online Legal Consultancy service, through an automated computer system provided by Wolep.com and shall be sent by email to the Client after the service is provided.
5.20. Wolep.com shall collect from the Client, before the time when the Online Legal Consultancy starts, through an online payment by credit card, the full amount of the fee established by the Lawyer and undertakes to transfer to the Lawyer's bank account these amounts after the time when the Legal Consultancy was performed, for the entire period of time purchased but not later than 35 days from the date of starting the Consultancy, if the purchased period of time has not been fully consumed.
5.21. A legal relationship specific to the Commercial Mandate Contract shall be established between Avocatura Com SRL and the Client, in which the Client, before receiving the Online Legal Consultancy, empowers Avocatura Com SRL that on behalf of the Client and for the Client to pay for the Online Legal Consultancy service to the Lawyer who has provided the Consultancy but only after the time when the Legal Consultancy service was performed or is deemed to have been performed.
5.22. In order to fulfil the entrusted mandate, the Client pays to Avocatura Com SRL, through an online payment made with a credit card, the amount necessary to pay the Fee established by the Lawyer. Avocatura Com SRL undertakes to transfer this amount to the Lawyer's bank account after the time when the Legal Consultancy was performed for the entire period of time purchased but not later than 35 days from the date of the starting the Consultancy, if the purchased period of time has not been fully consumed.
5.23. For the use of the platform made available to the Client but also for the proper fulfilment of the mandate entrusted by the Client through which Avocatura Com SRL makes the payment of the fee to the Lawyer, on behalf of and for the Client, Avocatura Com SRL shall charge from the Client a price of 10 Euro.
5.23. In order to avoid any misunderstandings, the Client states that they understand and assume the content of the commercial mandate entrusted to Avocatura Com SRL as described herein.
6. SERVICES FOR LAWYERS
6.1. The profile page is that page on the Wolep.com website where the contact details of each lawyer in the WOLEP International Network of Lawyers are presented. It includes public information, respectively: the surname and name of the Lawyer, the address of the form of exercising the profession, the telephone number and possibly the email address. Lawyers who have an Account on Wolep.com may add a photo and edit this data free of charge. Wolep.com offers Lawyers the opportunity to provide visitors to this page with other information in order to present their professionalism, practice areas, professional success and even a collection of appearances in the media of the lawyer. By editing these sections, the Lawyer satisfies the right to information of consumers on legal services.
6.2. Wolep.com gives Lawyers the right to edit their profile page so that it contains specific information if the Lawyer has been invited to join the WOLEP International Network of Lawyers and has subsequently been accepted as a member of this Network.
6.3. Articles, interviews, advertorial articles - are those advertising services that consist in the writing by the editors of Avocatura Com SRL of articles, interviews and advertorial articles, where the Lawyer is interviewed or presented. These editorial materials aim to transmit to the general public that information that may contribute to the creation, consolidation or growth of a personal brand of the Lawyer. These services are only available to Lawyers in the WOLEP International Network of Lawyers at a price that is displayed on the website next to this option.
6.4. The professional profile page as well as the articles, interviews and advertorial articles, may be the subject of Promotional Campaign through the Facebook page belonging to Wolep.com, a service provided by Avocatura Com SRL at a price that is displayed on the website next to this option.
6.5. ADVO PLUS - is a CRM application offering the possibility for Lawyers to manage their court or consultancy files, contracts, clients, activities, revenues and expenses with the possibility of generating expense reports, activity reports, invoices and receipts. At the same time, the possibility of storing documents, files, etc. in electronic format, in a secure electronic archive, is offered as well. This application is offered to Lawyers at a price/ lawyer and for a period of one year. The price is displayed on the website next to the description of this product.
7. ORDER - RETURN
7.1. The Client/Purchaser place Orders on the Website, by pressing the corresponding “Order” button for 30, 60 or 90 minutes of Video-audio Legal Consultancy or for the Request for Drafting a Legal Document and completing the process to be followed. The Order is completed upon payment in one of the ways expressly indicated. Initiating an “Order”, in the absence of its completion by payment, does not entail the registration of an order, nor implicitly the automatic booking of the Online Legal Consultancy service.
7.2. By completing the Order, the Purchaser agrees that all data provided by them, necessary for the purchase process, are correct, complete and true at the date of placing the Order.
7.3. By completing the Order, the Purchaser agrees that the Lawyer may contact them, by any means available/agreed by the Lawyer, in any situation where it is necessary to contact the Purchaser.
7.4. The Lawyer may cancel the Order placed by the Purchaser, following prior notice to the Purchaser, without any subsequent obligation of either party to the other or without either party being able to claim damages from the other party in the following cases:
7.4.1. non-acceptance of the transaction by the issuing bank of the Purchaser 's card, in the case of online payment;
7.4.2. invalidation of the transaction by the card processor approved by Wolep.com, in the case of online payment;
7.4.3. the data provided by the Client/Purchaser on the Website are incomplete and/or incorrect.
7.5. The Purchaser has the right to withdraw from the Contract, respectively to renounce a Service, within 14 calendar days, without invoking any reason and without bearing other costs. Thus, the period of renouncing a Service expires within 14 days from:
7.6. If the Purchaser decides to withdraw from the Contract, they will be able to cancel that Order by accessing the "Cancel Order" button without being asked for any motivation. The payment made for that Order (Paid Fee) shall be refunded to the Buyer / Client within a maximum of 14 days by transfer to their account.
7.7. If the Client/Purchaser requests the withdrawal from the Contract within the legal term of withdrawal from the contract, they must also return any gifts that accompanied that product. If the Order is paid, the Lawyer through the Wolep.com website shall refund the amount within a maximum of 14 (fourteen) days from the date of the Lawyer through the Wolep.com website being informed by the Purchaser of their decision to withdraw from the Contract. The amount shall be returned as follows:
7.7.1. for Orders paid online by card -> by refund to the account from which the payment was made;
7.8. If a Service ordered by the Purchaser cannot be delivered by the Lawyer, the latter shall inform the Client/Purchaser of this fact and shall return to the Purchaser's account the equivalent value of the Service, within maximum 7 (seven) days from the date on which the Lawyer became aware of this fact or from the date on which the Purchaser expressly stated their intention to terminate the Contract.
8. SERVICES FOR WHICH THE RIGHT OF WITHDRAWAL IS NOT ENSURED
8.1. The following are exempted from the right of withdrawal from the Contract:
8.1.1. Online Video/Audio Legal Consultancy, after the provision of the legal service begins;
8.1.2. Provision of services whose price depends on financial market fluctuations which the Lawyer cannot control, and which may take place during the withdrawal period;
8.1.3. Drafting a Legal Document/Drafting Legal Documents made to the specifications presented by the Purchaser or clearly customised;
8.1.4. Provision of digital content that is not delivered on a material medium (Drafting a Legal Document), if the service began with the express prior consent of the Purchaser;
8.1.5. Specific to the services provided by Lawyers through Wolep.com is the fact that all communications between Lawyer and Purchaser are confidential. Wolep.com will not be able to make any assessment regarding the quality or quantity of the information transmitted by the Lawyer to the Client / Purchaser nor will be able to assess whether the video or audio Online Legal Consultation Service, or the Drafting of a Legal Document was made according to the Client's/Purchaser's expectations. This is why a refund of the price for the Services started cannot be made.
9.1. Wolep.com shall maintain the confidentiality of any information you provide. Disclosure of the information provided shall be made only in accordance with the law. The Name, Surname, the telephone number and the email address provided by the Client to the Wolep.com website shall be communicated according to the purpose for which they were communicated to the Wolep.com website, respectively:
- To the Lawyer chosen by the Client only for the purpose of facilitating the contact or communications between the Client and the Lawyer and
- They shall be used by the Wolep.com website in order to achieve communications designed to facilitate the necessary steps to use the services of Online Legal Consultations and to choose the Lawyers appropriate to the Client's needs.
9.2. No public statement, promotion, press release or any other means of disclosure to third parties shall be made by the Purchaser/Client regarding the Order/Contract without the prior written consent of the Seller.
9.3. By transmitting information or materials through the Legal Consultancy Online or Live Chat IT application, you only give the Lawyer access to them, the Lawyer being properly obliged to maintain the confidentiality of this information.
9.4. Wolep.com does not interfere in any way in the communication between the Lawyer and the Client, the communication between them being protected by the professional secrecy of the Lawyer and by the technical protection measures taken by Wolep.com.
9.5. The data, information, documents, notes, mentions and any kind of information uploaded or mentioned in any way in the ADVO PLUS application are totally inaccessible to Wolep.com and are subject to the security measures implemented, so Wolep.com assumes the confidentiality thereof.
9.6. Communications between Lawyers or between Lawyers and Clients through the Live chat application are inaccessible to Wolep.com and are subject to the security measures implemented, so Wolep.com assumes the confidentiality of them.
9.7. Public communications made by Lawyers or other parties through articles, press releases, interviews, announcements, profile pages and any other similar communications, are intended to inform the general public and are not affected by the obligation of confidentiality assumed by Wolep. com.
10. COMMERCIAL COMMUNICATIONS
10.1. The Purchaser/User/Client may change at any time the option regarding the consent given to the Seller for Commercial Communications containing general and thematic information, including information regarding offers or promotions, as follows:
- by changing the settings in the Account in the "My Account" section, then "Update data".
11. INVOICING - PAYMENT
11.1. The prices of the Services displayed on the Wolep.com website include VAT according to the legislation in force.
11.2. The price and payment method are specified in each Order. The Seller shall send to the Purchaser an invoice for the Online Legal Consultancy service and an invoice for the fee collected by Wolep.com, the Purchaser's obligation being to provide all the information necessary for issuing the invoice in accordance with the legislation in force.
11.3. The Seller shall send to the Purchaser the invoice related to the Order containing Services sold by the Lawyer and by Wolep.com, by e-mail, to the e-mail address mentioned by the Purchaser in their Account.
11.4. For a correct communication of the invoice related to the Order, the Purchaser has the obligations to update whenever necessary the data from their Account and to access the information and documents related to each Order, existing in the Account.
11.5. Through this method of communication, the Purchaser, accessing their Account, shall keep track of the invoices issued by Wolep.com and the Lawyers, being able to save and archive them in their turn at any time and in any way they wish.
11.6. By sending the Order, the Purchaser agrees to receive the invoices in electronic format by e-mail to the e-mail address mentioned in their Account.
11.7. If this information is unavailable for more than 48 (forty-eight) hours in the Account, please notify us at the email address: email@example.com.
11.8. Payment by PaybyClick is a fast way of online card payment, which consists of making the payment with a single click by using the Token related to the card, without the need to enter the details of the payment card for each Transaction.
11.9. The payment card data of the User/Purchaser shall not be accessible to Avocatura Com SRL nor shall be stored by Wolep.com or by the payment processor integrated in the Website, but only by the institution authorizing the Transaction or another entity authorized to provide card identification data storage services, of whose identity the User/ Purchaser shall be informed prior to entering the data.
11.10. In certain cases, in order to maintain the security of the Transactions, when registering the Order, the Purchaser shall be required to authorize the payment by re-entering the password related to their Account, to use the fingerprint in the case of mobile terminals that have this facility.
11.11. For security reasons of Transactions, the User/Purchaser is advised not to remain logged in to the Website and not to set the option of automatic linking on mobile devices. Disclosure of the account access password is not permitted, and it is recommended to use a strong security password (e.g.: it should contain at least eight characters, including uppercase, lowercase, digits and special characters)
12. SERVICE DELIVERY
12.1. The delivery of the Online Legal Consultancy service shall be made through the IT platform made available by Wolep.com to both the Lawyer and the Client at the date and time agreed by them. The Client and the Lawyer may agree that the provision of the Online Legal Consultancy service should be also performed through communication via other means of communication, telephone etc.
12.2. The delivery of the ADVO PLUS application shall be made by granting the right of access and the right to upload and process data.
12.3. The delivery of the Professional Profile service shall be made by granting the right to edit the sections named: professional description, editing skills-practice areas, editing achievements, activating testimonials and editing media records.
12.4. The delivery of the services: advertising for the profile page and advertising for articles shall be made by attracting visitors to the respective pages as a result of advertising campaigns through Facebook.
12.5. The delivery of the service: interview, article or advertorial article shall be made by publishing on the Wolep.com website the respective editorial material written by the Wolep.com’s editors.
12.6. The delivery of the service: announcement or publication of a specialised article shall be made by publishing on the Wolep.com website the announcement or the specialised article written by the Lawyer if they comply with the public communication standards appreciated by Wolep.com.
13.1. The Seller shall not be liable for damages of any kind that the Purchaser or any third party may suffer as a result of the Seller's fulfilment of any of their obligations under the Order and for damages resulting from the use of the Services after delivery.
13.2. By creating and using the Account, the User/ Purchaser shall take liability for maintaining the confidentiality of the Account data (user and password) and for managing access to the Account, and, to the extent permitted by the legislation in force, shall be liable for the activity carried out through their Account.
13.3. By creating the Account and/or using the Content and/or placing Orders, the Client/User/Purchaser expressly and unequivocally accepts the Terms and Conditions of the Website in the latest updated version that is communicated within the Website, existing at the time of Account creation and/or use of the content and/or at the date of placing the Order.
13.4. The Seller reserves the right to periodically update and change the Terms and Conditions of the Website in order to reflect any changes to the manner and conditions of operation of the Website or any changes to legal requirements. The Document is opposable to Clients/Users/Purchasers from the moment of being displayed on the Website. In the event of any such changes, we shall display the amended version of the Document on the Website, and therefore please check the contents of this Document periodically.
14. WRITING REVIEWS, COMMENTS, QUESTIONS AND ANSWERS
14.1. The writing of Reviews, Comments, Questions and Answers can be done, by Users/Clients/Purchasers, in the “Reviews” sections. The information entered can be both positive and negative and shall refer to the characteristics of the Lawyer's professionalism as perceived.
14.2. Upon registration of a particular Review/Comment/Question/Answer on the Website, Users/Clients/Purchasers grant the Seller a non-exclusive, perpetual, irrevocable, territorially unlimited licence and give the Seller the right to use, reproduce, modify, adapt, publish, translate, share, delete and display this content.
14.3. Each User/Client/Purchaser, at the time of submitting the Review/Comment/Question/Answer in the referred sections, undertakes to comply with the following rules:
– to make references only to the characteristics and/or the way of using a service, avoiding information related to aspects that can change (price or promotional offers) or information related to the way the Order is carried out;
– to use only the language they know. Words or phrases that are widely used in all media related to the respective field are also allowed;
– to use appropriate, non-offensive language, without terms that may offend or affect any other User/Client/Purchaser;
- to ensure the correct inclusion of the content introduced on the Website as follows: any Question shall be entered in the “Client Questions and Answers” section, and any Review shall be entered in the “Reviews” section;
– to ensure that the information they enter is realistic, correct, not misleading and in accordance with the applicable laws, thus observing the rights of other parties, copyright, trademark, licence or other proprietary, publicity or privacy rights;
– to use this facility only to communicate or obtain additional details regarding a particular service on the Website without referring to other companies that promote the sale and purchase of similar products or services;
– not to provide or request, in any way or to any extent, personal data (contact details, delivery or domicile address information, telephone numbers, email addresses, first and last name etc.) or any other information that may lead to the disclosure of such personal data;
– not to enter information and/or details about URLs (links) from other commercial websites that carry out the same commercial activity as the Seller;
– not to try to defraud the services provided by the Seller or to enter Reviews/Comments/Questions/Answers containing materials of an advertising nature;
– not to use the Review/Comment/Question/Answer as a means of communication with the Seller, in this regard the contact details of the Seller registered on the Website shall be used.
14.4. In addition to a realistic critical evaluation, when registering a Review, the User/Client/Purchaser shall also add a relevant Rating for the Lawyer providing the Online Video/Audio Legal Consultancy. The reviews, together with their respective Ratings, will influence the Lawyer's overall Rating. Thus, a Review accompanied by a high Rating leads to an increase in the overall Rating, and a Review accompanied by a low Rating leads to a decrease in the General Rating.
14.5. When a Review/Comment/Question or Answer is reported by a User/Client/Purchaser as having inappropriate content, from a strictly subjective perspective, this content is carefully examined by the Seller to determine whether it breaches the Website’s Terms and Conditions.
14.6. If the Seller finds a breach of the Terms and Conditions repeatedly, the Seller reserves the right to suspend the ability of the User/Client/Purchaser to submit Reviews/Comments/Questions or Answers in the "Client Questions and Answers" and " Reviews" sections.

The maximum term for resolving complaints or notifications is 30 calendar days from their receipt.
15. PROCESSING OF PERSONAL DATA

17. FORCE MAJEURE
17.1. Neither party shall be liable for the non-performance of their contractual obligations if such failure to perform on time and/or properly, in whole or in part, is due to a force majeure event. Force majeure is the unpredictable event, beyond the control of the parties and which cannot be avoided.
17.2. If within 15 (fifteen) days from the date of its occurrence the respective event does not cease, each party shall be entitled to notify the other party of the full termination of the contract without any of them being able to claim damages from the other.
18. APPLICABLE LAW - JURISDICTION
18.1. This contract is subject to Romanian law. Any disputes between Seller and Users/Purchasers shall be settled amicably or, if this is not possible, disputes shall be settled by the competent courts in Romania.
